Welcome to the website kolaci-martinec.hr (hereinafter: "Website"). This Website is managed by MARTINEC USLUGE d.o.o. (hereinafter: "Company" or "we"). By accessing and using this Website, you accept the following Terms of Service (hereinafter: "Terms"). Please read these Terms carefully before using our Website. If you do not agree with these Terms, please do not use this site.

You may use the Website only for lawful purposes and in a manner that does not restrict or interfere with the use of the site by other users.

The following are prohibited:

  • Spamming or sending unsolicited messages

Product availability is displayed on the Website. Baked products commence production only after order confirmation to ensure maximum freshness. We reserve the right to limit availability or temporarily remove a product from our range without notice.

5. ORDERING PRODUCTS

5.1. Ordering Procedure

Products may be ordered via:

We recommend placing your order at least 5-7 days in advance. During holiday periods (Easter, Christmas, New Year), we recommend allowing an even longer timeframe to ensure availability.

5.3. Order Confirmation

Upon receipt of your order, the Company will contact you to confirm the following details:

  • Type of product (pastries, cakes, confectionery)

  • Size/quantity (number of servings, number of items, weight)

  • Flavours

  • Decoration (cream, fondant, icing, figurines, toppers or special requests)

  • Collection/delivery date

  • Special requirements, additions or allergies

5.4. Order Amendments

Order amendments are possible up to 3 days before the agreed date. After this deadline, the Company may refuse the amendment or charge additional fees for any changes to the production process.

6. PRICING AND PAYMENT

6.1. Prices

All prices are quoted in euros (EUR) and are displayed on the Website, in our price list or during order arrangement. Prices include VAT. We reserve the right to change prices without prior notice; however, the price will be fixed upon order confirmation.

6.2. Payment

Payment may be made via:

  • Cash or card - Upon collection of products

  • Bank transfer - Details provided after order confirmation

  • Other methods - By prior agreement

A deposit or full payment may be required for larger orders or orders with special requirements.

7. DELIVERY AND COLLECTION

7.1. Delivery

Delivery is arranged within the Velika Gorica, Zagreb and surrounding areas. Exceptions are possible for larger orders. Delivery charges are negotiated depending on distance and product quantity. Products are delivered by the Company in refrigerated units to ensure freshness.

7.2. Collection

Products may be collected from: Šćitarjevo 100/1, 10410 Šćitarjevo, Croatia, at an agreed time during business hours.

7.3. Business Hours

Delivery/collection hours are arranged individually during the ordering process. Our regular Business Hours can be found on our Contact page.

7.4. Damage During Transport

The Company ensures safe delivery. However, should product damage occur during delivery, damage must be reported immediately upon receipt. Photographic evidence must be provided without delay.

8. ORDER CANCELLATION

8.1. Cancellation by Customer

A customer may cancel an order no later than 3 days before the agreed delivery/collection date.

8.2. Refund Terms

  • Cancellation 7 or more days in advance: Full refund

  • Cancellation 3-6 days in advance: Possible deduction of 10-25% of costs for materials already purchased

  • Cancellation less than 3 days in advance: Possible charge for all costs (materials purchased, labour, etc.)

The exact refund amount is determined by the Company based on the specifics of the order.

8.3. Cancellation by Company

The Company reserves the right to cancel an order due to:

  • Inability to source raw materials

  • Serious health issues affecting staff

  • Force majeure

  • Breach of Terms of Service by the customer

9. COMPLAINTS AND COMPLAINTS PROCEDURE

9.1. Complaints Period

Complaints regarding the quality, flavour or appearance of products are accepted within 24 hours of collection/delivery.

9.2. Complaints Procedure

Complaints should be submitted by email or telephone with a description of the problem and photographs. For complaints regarding cakes, a photograph of the entire cake and detailed images of the problem area are required.

9.3. Complaint Resolution

In the case of a valid complaint, the Company will offer:

  • Product replacement (where possible)

  • Refund (full or partial)

  • Discount on your next order

  • Other appropriate solution

The final decision is made by the Company following assessment of the complaint's validity.

10. STORAGE, ALLERGENS AND HEALTH INFORMATION

10.1. Allergen Contamination

Please notify us of any allergens when placing your order. Whilst the Company strives to prevent contamination, products are prepared in a kitchen where the following substances are used:

  • Gluten (cereals containing gluten; wheat, rye, barley, oats, spelt and their hybridised variants)

  • Milk and milk products

  • Eggs and egg products

  • Tree nuts (hazelnuts, almonds, walnuts, peanuts, pistachios)

  • Sesame

  • Sulphites

10.2. Ingredients

All ingredients used are of premium quality. For a detailed ingredient list for a specific product, please contact the Company before ordering.

10.3. Storage After Delivery

Products should be stored at a temperature of 2-4°C in a dark and dry location. Storage periods are: up to 7 days for pastries, 5-7 days for cakes, and 5 days for Cream Puffs and Custard Slices. The customer is responsible for proper storage after delivery.

11. PERSONAL DATA PROTECTION

Your personal data collected via the Website, during ordering or communication is used solely for:

  • Processing and fulfilling your order

  • Communication relating to your order

  • Sending notifications about new products (only if you have opted in)

We will not share your data with third parties without your consent, except where required by law (such as customs and tax authorities).

17. APPLICABLE LAW AND DISPUTE RESOLUTION

These Terms are governed by the law of the Republic of Croatia. Any provisions which conflict with the law shall not apply. In case of dispute, the parties will attempt to resolve the matter through negotiation. Should negotiation fail, the competent courts in Velika Gorica or Zagreb shall have jurisdiction.

18. EXTENDED DELIVERY AND SPECIAL OCCASIONS

For orders for special occasions (weddings, major events, corporate functions), please contact us at least 14 days in advance. We can consider customised solutions, special flavours or quantities.

19. CODE OF CONDUCT AND PROTECTION AGAINST MISUSE

Users agree not to:

  • Send threats or offensive messages

  • Attempt to access protected parts of the Website without authorisation

  • Falsify identity or impersonate other persons

  • Scan the Website using automated tools without permission

The Company reserves the right to suspend Website access for users who breach these rules.
